These Terms govern the supply of diving services by K2Diving Krzysztof Miłek ("we") trading as Big Nomad via bignomad.com to consumers resident in the United Kingdom ("you"). They are written in line with the UK Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2. Contract formation

A contract is formed when we send you written confirmation of your booking after receipt of the deposit. All quotes are valid for 14 days unless stated otherwise.

3. Pre-contract information

Before booking we provide a written itinerary, the price in GBP including all mandatory taxes and fees, inclusions and exclusions, the identity of the service provider, our complaints procedure and these Terms.

4. Services

We will perform diving services with reasonable care and skill, as required by section 49 of the Consumer Rights Act 2015. Conditions at sea may require itinerary changes; we will always prioritise diver safety.

5. Right of withdrawal

Under the Consumer Contracts Regulations 2013 you generally have 14 days to cancel a distance contract. However, leisure services for a specific date or period (regulation 28(1)(h)) are exempt from the right of withdrawal once performance is scheduled. By booking a dated diving programme you acknowledge this exemption. Our voluntary refund terms are set out in the Booking & Cancellation Policy.

6. Price & payment

Prices are quoted in GBP. A deposit of 25% secures your booking; the balance is due 30 days before the start of the programme. We accept bank transfer and major card payments via our processor.

7. Your obligations

You confirm that you hold a recognised dive certification appropriate for the programme booked, valid personal dive insurance, and that you are medically fit to dive. You agree to follow all briefings and reasonable instructions from our guides.

8. Liability

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited under English law. Subject to that, our total liability for any claim is limited to the price paid for the affected programme.

9. Complaints

Please raise any complaint with us first, by email to [email protected]. We will respond within 14 days. If unresolved, UK consumers may use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

10. Governing law

These Terms are governed by the laws of England and Wales. UK consumers retain the protection of the mandatory rules of the country in which they reside. The courts of England and Wales have non-exclusive jurisdiction.
